If I use an LLC do I still need a living trust?
An LLC should be used in conjunction with a revocable living trust. Although the living trust does not provide any asset protection benefits, it is useful in accomplishing certain estate planning objectives. A funded living trust will avoid probate on family assets and will provide for the disposition of the property upon the death of a spouse. However, because the assets of the living trust will be exposed to a creditor, upon the death of a spouse, most people prefer to use an LLC together with the Living Trust. This arrangement provides protection during lifetime and at death.
